Third OWI Penalties:

  • Felony punishable by a mandatory 30 days in jail, up to 5 years
  • Mandatory one year driver license suspension

Blood Alcohol Content (BAC)

A BAC of 0.17 or higher increases penalties

DUI Law Specifics:

Under Michigan’s Implied Consent Law, all drivers are required to take a chemical test to determine their blood alcohol content (BAC) if they are suspected to be operating under the influence. Drivers provide this consent when they receive their license, and refusal to take a test may result in a hard suspension of a license for one year. However, with a good defense attorney, appealing to the Secretary of State may result in a dismissal of the hard suspension.
